All drawings and descriptions are as viewed from the outside. Therefore APS Joinery Pty Ltd. will not be held responsible if the handing of any window is incorrect. All timber profiles are standard, unless otherwise specified. Materials are subject to availability. Delivery is not included, unless specified. Unloading of goods to be provided by the customer. All quantities and details of the quote are to be checked by the customer before confirming acceptance of quote by payment of deposit. No responsibility will be taken for what is NOT shown in the quote by APS Joinery Pty Ltd.

Placing an Order: An order is deemed to be accepted by the customer upon the payment of an initial deposit amount as deemed appropriate by APS Joinery Pty Ltd. Customers MUST also sign off on production drawings (when supplied) prior to APS Joinery Pty Ltd commencing a job. An order will not be processed until monies have been received and production drawings are signed (when issued), unless agreed upon in writing by the customer and APS Joinery Pty Ltd. No refund of a deposit on cancellation of works once the deposit has been paid. Payment of deposit confirms the customers’ acceptance of these Terms and Conditions of Sale. Any person who accepts this quote warrants he is the duly authorised agent of the customer for the purpose of placing the order.

Variations: If there is any variation in a products specifications after an order is placed, that variation must be submitted to APS Joinery Pty Ltd in writing and signed and dated by the customer. APS Joinery Pty Ltd reserves the right to amend any price in accordance to any variation.

Orders which involve delivery or customer pick-up only

Goods will not leave the factory unless paid for in full and cleared funds are available, unless agreed otherwise by both parties prior to placement of order. Upon completion of works by APS Joinery Pty Ltd, the balance of the quotation’s full amount must be paid in full before delivery or pick-up. Customers can view their orders prior to delivery. Once delivered or picked-up, the client takes full responsibility of the windows and/or doors. Property of the goods supplied by APS Joinery Pty Ltd to the Customer will not pass to the Customer until the money owing for those Goods and any other money owing by the Customer has been paid. The Customer in the meantime, takes custody of the Goods as the fiduciary agent and Bailee of APS Joinery Pty Ltd.

Orders which involve installation by APS Joinery Pty Ltd

APS Joinery Pty Ltd requires three progress payments to be made where installation is offered to the customer. On signed acceptance of the quote, 50% of the full amount is required. When the order is completed, and before despatch from our factory, 40% of the balance of the full amount is required. When delivery and installation are completed the remaining 10% is required to be paid on the day of installation. Of said amounts which remain unpaid, all goods and services shall remain the property of APS Joinery Pty Ltd.

Overdue monies
If any time monies are overdue, APS Joinery Pty Ltd may charge interest on all overdue accounts at a rate of 2% per month calculated on a daily basis. The customer shall pay all costs and expenses (including legal costs) incurred by APS Joinery Pty Ltd. and/or its agents in respect of the customer whether relating to any debt, possession of products and/or otherwise.

Warranty
APS Joinery Pty Ltd. guarantee their products against defects arising solely from faulty workmanship or materials for a period of 7 years from the date of delivery, pending the following conditions:

1. The product has been correctly installed in accordance with the relevant Australian Standards and recognized building practices. APS Joinery Pty Ltd will not take responsibility if windows are installed out of level and plum if windows and doors have been installed by a third party.
2. The product has not been subject to any misuse, physical abuse, neglect or accident, however arising.
3. Was not damaged as a result of environmental conditions, natural disasters or other events beyond the control of APS Joinery Pty Ltd.
4. The window or door has not been repaired modified or altered by a person who is not a company employee or agent.
5. Timber windows and doors are sealed within 3-4 days from date of delivery with a minimum of two coats of varnish or paint to both faces and ALL edges, including top and bottom edges. Clients must provide paint receipts to validate warranty or sign off from professional painter.
6. Immediately upon delivery, windows and doors must be stored in a dry area and not in damp, moist, freshly plastered areas and out of direct weather. All doors must be laid flat.
7. Proof of purchase.

All doors greater than 2400mm high or 1200 wide are not warranted against bow or twist. Due to the nature of timber, doors may contain a warp of up to five millimetres across a two metre length. Moving parts, which wear out as a part of normal use are guaranteed for a period of 3 years. This guarantee is limited to the repair or replacement of the faulty product but does not extend to the installation or refinishing of the replacement product unless these services were originally contracted to APS Joinery Pty Ltd.
Only repairs carried out by APS Joinery Pty Ltd. personnel or authorised APS Joinery Pty Ltd. agents are covered by this guarantee. Claims under this guarantee should be made within one month of the defect arising in the product. Copies of the original purchase documentation should be included with your written claim, and lodged in written form. This warranty does not cover general deterioration in appearance or performance that occurs as a result of normal operation. This guarantee is in addition to all other rights and remedies in respect of this product to which you are entitled under the Trade Practices Act and similar State and Territory laws.
